PulsePoint Terms and Conditions

1. Introduction

Welcome to PulsePoint. These Terms and Conditions govern your access to and use of the PulsePoint platform, including the website, mobile applications, APIs, and related services operated by TechTrek Africa.

By registering for, accessing, or using PulsePoint, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform.

2. Definitions

  • “Platform” means the PulsePoint website, mobile applications, APIs, and related systems.
  • “User” means any person or business that accesses or uses the platform.
  • “Business” means any business account or operation managed through PulsePoint.
  • “Services” means the software features, tools, reports, messaging services, and related functions made available through PulsePoint.

3. Nature of the Service

PulsePoint is a software platform that helps users manage business operations, including but not limited to:

  • sales and service tracking,
  • client management,
  • user and staff access control,
  • subscriptions and billing,
  • SMS communication and campaigns,
  • reporting and analytics,
  • mobile and web-based operational workflows.

PulsePoint does not own, run, supervise, or control the businesses using the platform. Each business remains solely responsible for its own pricing, staff, services, sales, communications, compliance, and daily operations.

4. User Accounts

To use certain features, you must register an account and provide accurate information.

  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activities under your account.
  • You must promptly update inaccurate or outdated information.

PulsePoint shall not be liable for losses arising from unauthorized access caused by your failure to protect your credentials.

5. Subscription, Billing, and Access

  • Some features require an active paid subscription or valid usage entitlement.
  • Fees are payable according to the plan or pricing structure applicable at the time.
  • Failure to pay may result in feature restrictions, suspension, or deactivation of affected businesses or accounts.
  • Unless required by law, payments already made are non-refundable.

PulsePoint reserves the right to change pricing, plans, or included features on reasonable notice.

6. Acceptable Use

You agree not to use the platform to:

  • violate any law or regulation,
  • send spam or unlawful promotional communications,
  • upload malicious code,
  • attempt unauthorized access to systems or data,
  • interfere with performance, security, or availability of the platform,
  • misuse reports, client data, images, payment records, or communications tools.

7. User Data and Business Responsibility

Users are solely responsible for all data submitted to or managed through PulsePoint, including customer information, payment references, uploaded files, client records, vehicle details, images, campaign content, reports, and operational entries.

  • You warrant that you have the right to collect and use any data you enter into the platform.
  • You remain responsible for the accuracy, legality, and integrity of your data.
  • You should keep your own backups of important business information.

8. SMS, Notifications, and Campaign Messaging

PulsePoint may provide messaging functionality, including SMS ordering, operational notifications, and promotional campaign tools.

  • You are responsible for ensuring you have the required consent to contact recipients.
  • You may not use the platform for unlawful, deceptive, abusive, or unsolicited campaigns.
  • SMS delivery depends on third-party providers and network availability.

PulsePoint is not liable for delayed or failed delivery caused by third-party messaging providers or mobile networks.

9. Third-Party Services and Integrations

The platform may depend on or integrate with third-party services such as hosting providers, payment providers, messaging gateways, cloud storage, mobile operating systems, barcode scanners, cameras, and related hardware or software.

PulsePoint is not responsible for the availability, accuracy, pricing, compatibility, or performance of third-party services.

10. Service Availability

While we aim to keep PulsePoint available and reliable, the platform is provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted or error-free availability. Downtime may occur due to:

  • maintenance, updates, or deployments,
  • infrastructure or hosting issues,
  • internet or network failures,
  • third-party outages,
  • security events or emergency fixes.

11. Limitation of Liability

To the maximum extent permitted by law, TechTrek Africa and PulsePoint shall not be liable for any indirect, incidental, special, consequential, or business losses, including but not limited to:

  • loss of profits,
  • loss of revenue,
  • loss of business opportunity,
  • loss of data,
  • missed sales or operational interruptions,
  • client disputes, theft claims, or staff misuse,
  • errors caused by incorrect user input or third-party system failures.

Your use of the platform is at your own risk.

12. Intellectual Property

All rights, title, and interest in the PulsePoint platform, including software, branding, design, text, workflows, reports, and related materials, remain the property of TechTrek Africa or its licensors.

You may not copy, reverse engineer, resell, redistribute, or exploit the platform except as expressly permitted in writing.

13. Suspension and Termination

We may suspend, restrict, or terminate access to the platform where:

  • fees remain unpaid,
  • these Terms are breached,
  • fraudulent, abusive, or unlawful activity is suspected,
  • continued access creates security, legal, or operational risk.

14. Changes to the Terms

We may update these Terms and Conditions from time to time. The latest version published on this page will apply from its effective date. Continued use of the platform after changes means you accept the revised Terms.

15. Governing Law

These Terms and Conditions are governed by the laws of South Africa. Any disputes arising from or related to the platform shall be subject to the jurisdiction of the South African courts.
